Nintendo Sues More Hack Sellers, 'a Worsening International Problem' (polygon.com) 41

Nintendo of America has filed a lawsuit against an Amazon Nintendo Switch hack reseller -- the sort of litigation it's taken on in similar cases in the past. Nintendo's lawyers allege the Amazon seller, Le Hoang Minh, circumvents Nintendo's copyright measures in selling an RCM Loader, used to "jailbreak" the Nintendo Switch. From a report: The lawsuit was filed in a Seattle court last week, according to court documents obtained by Polygon. In the lawsuit, Nintendo outlines what it calls a "serious, worsening international problem" with video game software piracy. It details Nintendo's security systems, and how the RCM Loaders bypass those systems. The RCM Loader (which is essentially a USB device that plugs into the Nintendo Switch) allows the user to play so-called "pirated" or unauthorized games. According to the lawsuit, Nintendo sent a DMCA notice to the seller, to which a counterclaim was issued. Because of the counterclaim, Amazon was required to relist the RCM Loader, unless Nintendo filed an infringement lawsuit. And that's what it did. The company is looking for the courts to stop the seller, and award it $2,500 in damages for each infringement.

    A car company telling me I can only have 'authorized' passengers in my car and only 'authorized' roads I can drive on and only 'authorized' parts being replaced by 'authorized' mechanics?

      the DMCA is crystal clear here. You do not have a right to make modifications to your property that allow you to bypass copy protection software or hardware. If you don't like it you need to change who you vote for.

        I hate to break it to you, but https://www.waveform.com/pages... [slashdot.org]>right to repair laws and DCMA reform are embraced by people of both sides and have existed for 20 years+ meaning both sides have had ample control.

        Looks like it’s come down to some specific people independent of party or a large upheaval of the system due to the massive backlog of policy both sides want but somehow never gets done.

        • it's nice that Europe's doing that, but they don't care nearly as much about IP as the United States does because, well, they've got a hell of a lot less of it.

          As far as I know there's no serious challenge to the DMCA provision that makes this illegal.

        I have changed for whom I vote. The candidate for whom I have voted has lost each time, as other issues have proved more important to the other millions of constituents in my state than copyright. What else is available to me?

        • The problem your seeing is that right wing, pro-corporate candidates tend to win. The solution is getting more young folks, who are less conservative, into the game. But there is active voter suppression in the form of 3-8 hour wait times at their polls.

          We need Universal Vote By Mail and Automatic Voter Registration. Ranked Choice voting would help to, as it would make 3rd parties viable and put the current 2 party system back on it's toes.

          You could run for office. If all of the candidates suck, be the better candidate.

        I don't think that's true. There is a legitimate use case for these. I can run Android, I can run Ubuntu, I can run all sorts of Homebrew apps on it. With the news of Ninty shutting down Mario Maker 1 (WiiU) today, I'm sure we all can foresee a day when a hacked switch will be the only way to get new levels for MM2.

        There's even an Open Source reimplementation of the kernel [wololo.net] and Open Source launcher [github.com] to help avoid any copyright violations.

        The DMCA is one of those.

        You can tell by it not preventing harm, but enabling and causing harm. (In this case, it does not make somebody taking sometbong illegal, but it makes not letting somebody take somethong from you illegal.)

            I'm sure they'll get right on that after they fix the bug that makes comments scrunch down to a couple characters wide.

            Hit the 3 dots and check "Desktop site" in Chrome. Slashdot mobile is broken and has been since it launched. Just please give me an option to stay on the Desktop site and never put that garbage on any of my browsers.

  • There are other brands that do allow me to play with MY device, I demand the right to make all the changes, repairs and mods that I want! This is just one more reason I will never ever buy nintendo trash,ever!

  • I will be buying a switch lite as soon as a clear "jailbreak" path comes clear. I hope to use it with moonlight for gamestreaming, as well as rock my old school emulation collection. I will also be buying quite a bit of software, Mario+Rabbids, the new Zelda franchise games, and others. It's got a pretty awesome library of games that I'm looking forward to playing in bed.

    Not making the buy until it runs unsigned code though. Nintendo has historically been pretty bad at security, and I'm certain it's only a

    • You do know that consoles aren't profit centers right? They make their money on the games, not the machines. You're threatening not to buy subsidized hardware and then never generate profit for the company - I'm sure they're quaking.

      If you want to play old NES games, you can get them licensed and official on the switch.

      • Not really a threat. More of a statement. I'll also be buying a ton of games... like I stated in my post. Point being I wont be giving any money to the mouse for games OR hardware until I can do what I want with it.

It's not my problem if you refuse to have a legitimate business model, based on exchanging money for work, and prefer a delusional snake oil one ... mased on imaginary monopol amd atificial scarcity ... that cannot work in the real world ... in order to steal infinite money for all etrnity ... for work of others that you only paid once.
